This is an amendment to the announcement issued on 9 February 2009 under RNS number 9682M which, in the third line, should have read "discontinued by consent of" not "withdrawn by agreement between". The rest of the announcement remains unchanged.

Update on proceedings

9 February 2009

Further to the announcement of 3 November 2008, ACP Capital Limited (AIM: APL) today announces that the proceedings instituted by Mishcon de Reya on 23 October 2008 relating to the recovery of legal fees have now been discontinued by consent of the various parties and the dispute has been settled on confidential terms acceptable to all parties.
